This Return and Refund Policy (“Policy”) governs the purchase of digital products and professional services from Make My Business Live (MMBL) (“Company,” “we,” “us,” or “our”). By accessing our website and purchasing our products or services, you (“Client,” “User,” or “Customer”) agree to the terms outlined herein.
I. General Non-Refundable Nature
Digital Goods Finality: Due to the intangible and irrevocable nature of digital products (software licenses, subscriptions, and AI tools), all sales are final. No refunds shall be issued once the product has been delivered or accessed.
Service Finality: Fees for professional services, including but not limited to Web Development, App Development, and UI/UX Design, are non-refundable as they represent compensation for labor-hours and specialized expertise.
Strict “No Refund” Mandate: MMBL maintains a strict no-monetary-refund policy across all categories to prevent “digital shoplifting” and unauthorized distribution.
II. Digital Products (Plugins, Licenses, Subscriptions)
Delivery Verification: A digital product is deemed “delivered” when the activation key, login credentials, or download link is sent to the Client’s registered email or dashboard.
Non-Delivery Claims: If a digital product is not delivered within the specified timeframe (usually instant to 24 hours), the Client must notify us immediately.
Replacement Protocol: If a digital product is proven to be non-functional or not as described at the time of delivery, MMBL will provide a one-time replacement of the same product at no additional cost.
Evidence Requirement: To qualify for a replacement, the Client must provide visual proof (screenshots/screen recordings) of the product’s failure within 2 hours of the delivery timestamp.
Compatibility Disclaimer: It is the Client’s responsibility to ensure hardware and software compatibility before purchase. No replacements will be issued for incompatibility issues.
Third-Party Terminations: MMBL is not liable for the termination of subscriptions (e.g., Office 365, Adobe) caused by the Client’s violation of the respective third-party provider’s terms of service.
III. Professional Services (Development & Design)
Scope of Work (SOW): Services are executed based on a signed SOW. Deviations from the original agreement requested after project commencement are subject to additional fees.
Promise of Delivery: A service is considered “not delivered as promised” only if it fails to meet the core functional requirements explicitly defined in the initial SOW.
Revision Entitlement: In cases where the delivered service does not align with the promised specifications, the Client is entitled to 3 to 5 extra revisions (at the Company’s discretion) to rectify the discrepancies.
Revision Limitations: Extra revisions apply only to the correction of the original scope. New feature requests or design changes outside the SOW do not qualify as “revisions” under this policy.
Client Delays: MMBL is not responsible for project delays caused by the Client’s failure to provide necessary assets, feedback, or approvals. Such delays do not constitute a breach of delivery promise.
Acceptance of Work: Upon the Client’s final approval or the deployment of a website/app to a live environment, the service is deemed completed and satisfactory.
IV. Compliance and Legalities
Fraudulent Chargebacks: Any attempt to initiate a credit card chargeback for a successfully delivered digital product or service will be viewed as a breach of contract. MMBL reserves the right to report such activity to credit bureaus and collections agencies.
Abuse of Policy: MMBL reserves the right to refuse replacements or revisions to any Client who demonstrates a pattern of policy abuse or deceptive behavior.
Force Majeure: MMBL shall not be held liable for failure to deliver services or products due to circumstances beyond our control, including global server outages or third-party API failures.
International Jurisdictional Variance: This policy is designed to align with international consumer protection laws for digital goods; however, local mandatory laws may apply where applicable.
Amendments: MMBL reserves the right to modify this Policy at any time. Continued use of the website following changes constitutes acceptance of the updated terms.
